By using or accessing this website you acknowledge that you have read, understood and agreed to be bound by the Terms and Conditions listed in this website. If you do not agree to the Terms and Conditions, please do not use this website.
This Terms and Conditions covers all our sales from this website.
All goods sold by us come with guarantees that cannot be excluded under the Australian Consumer Law.
You are entitled to a replacement or refund for a major failure. You are also entitles to have the goods replaced or repaired if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Goods presented for repair may be replaced by manufacturer-refurbished goods of the same type rather than being repaired.
Manufacturer Refurbished parts may be used to repair the goods.
Prices and Orders
All prices shown on this website are in Australian Dollars (AUD), are subjected to change without notice, and are exclusive of Goods and Services Tax (GST). Taxes will be added upon check out of your shopping cart at the current rate (10%)
Your order confirmation email will also show the included GST total and you will receive a final Tax Invoice from us once we have accepted your order and shipped. Invoices and Billing will be from IT Networks Australia Pty Ltd.
Prices change from time to time. Product prices are regularly updated when price changes are received from our suppliers. Please note that an order is an offer to purchase, and does not constitute a binding contract until it is accepted by us.
A binding contract only exists when we deliver your order.
Any automated confirmation of a successful order placement and/or receipt and/or our processing of a payment for an order through the Site does not constitute acceptance of an order by us. If we decline your order after payment for the order has been processed and or received we will contact you with the details and refund the payment in full.
We will acknowledge acceptance of your offer (contract) by shipping your order.
We require payments for all transactions to be cleared before delivery.
An order will not be accepted until we have received and cleared your payment in full.
Ownership of any product which you purchased will only be transferred to you when we have received and cleared your payment in full.
We do not charge for credit card transactions. So there are no additional surcharges to the payment price.
We are not responsible for any delay associated with processing your payment caused by third-parties or by financial institutions.
Changes or cancellation requests may be made to contact details on the web page after order placement. A restocking fee may apply. Orders already shipped cannot be cancelled.
You may change or cancel an order for goods which is on “back-order” status without incurring any restocking fee.
Shipping and Delivery
We ship to all destination is Australia.
We aim to ship all accepted orders, where products are in stock, as soon as possible.
Items will be dispatched within 1 to 3 business days after payment has been received in full and transit time may vary between 1 to 5 business days. Some areas may take longer due to frequency of deliveries to the delivery postcode. Once we dispatch your order/s, we will not be able to refund or change the order if you have changed your mind on your purchases unless the order/s arrives DOA or faulty.
Returns, Refunds and Exchanges
You are solely responsible for your purchase, so please choose your products carefully before purchasing and placing your order with us.
We are not required to provide a refund or replacement if you change your mind.
You can choose a refund or exchange if an item has a major problem. This is when the item:
- Has a problem that would have stopped someone from buying the item if they had known about it
- Is unsafe
- Is significantly different from the sample or description
Doesn’t do what we said it would or what you
asked for and can’t be easily fixed. Alternatively, you can choose to keep the
item and we will compensate you for any drop in value. If the problem is not
major, we will repair the item within a reasonable time. If it is not
repairable in a reasonable time you can choose a refund or replacement. Please
keep your proof of purchase.
You must pay for return shipping
Part Orders that have not been marked shipped or ready for shipping, you may request to have the order cancelled and be refunded in full. Once your goods are ready for shipping, you will be charged a restocking fee as well as any fee for return shipping.
The restocking fee is 25% of the total order.
We provide a 12 month from purchase RTB (Return to Base) warranty on goods we sell. Customers are liable for any return postage which may be incurred. When you RTB your goods, we will repair it, or, at our option replace it when we consider it defective.
Where we elect to replace the goods, the exact model of the goods may not be available. In such a case, at our discretion, we have the right to substitute the goods with a similar one.
If you have goods which you believe are faulty, please ensure that you thoroughly test it before returning it to us.
If goods, which you returned to us because you believe they are faulty, are later found not to be so or if the goods are faulty but are no longer under warranty, you may incur an administrative fee.
Goods will not be returned to you or tested until you have paid any administrative fee and return postage fee.
You need to provide proof of purchase when you are making a warranty claim.
You are responsible for the storage of all your invoices/receipts/bank statements/credit card statements.
You must return goods in its original packaging, or well packed so that the goods do not sustain any damage it transit. You must also return all software and manuals when you do so.
You must not return any software you claim to be defective. Under no circumstances will we accept returned software. We provide no warranty whatsoever with respect to any software.
Product descriptions are not warranted by us as correct, complete, current and reliable or error free. If the product is not as described, please return the product with all its original packaging.
Images on the website are for illustrative purposes only. Actual products may appear different to the products shown.
You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. If you are under 18, you may use the site only with a parent or guardian. We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion.
Limitation on Use
Customer hereby acknowledges that Products are not intended for use in life support systems, critical care application, human implantation, commercial aviation, nuclear facilities or systems or any other applications where product failure could lead to injury to persons or loss of life or catastrophic property damage. We hereby disclaim any liability or responsibility for risk of loss, expenses, cost, liability, litigation and/or potential adverse verdict or judgement in relation to any such use of the products.
Limitation of Liability
Except as specifically stated herein, neither IT Networks Australia Pty Ltd nor any of its directors, employees or other representatives will be liable for damages arising out of or in connection with your use of any Website. This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties.
IN NO EVENT SHALL SYNNEX BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, EXEMPLARY, PUNITIVE, SPECIAL OR OTHER DAMAGES WHATSOEVER RESULTING FROM OR RELATED TO CUSTOMER’S USE OF ANY IT NETWORKS AUSTRALIA PTY LTD WEBSITE OR OUR PERFORMANCE OR FAILURE TO PERFORM UNDER THIS AGREEMENT OR THE FURNISHING, PERFORMANCE OR USE OF ANY PRODUCT(S) SOLD PURSUANT HERETO, WHETHER DUE TO BREACH OF CONTRACT, BREACH OF WARRANTY, STRICT LIABILITY, PRODUCT LIABILITY, PERSONAL INJURY, THE NEGLIGENCE OF US OR OTHERWISE. OUR LIABILITY SHALL BE LIMITED SOLELY TO THE REPAIR, REPLACEMENT OR CREDIT OF THE PRODUCT(S), AT OUR OPTION.
WE SHALL NOT BE LIABLE TO CUSTOMER, CUSTOMER’S CUSTOMERS, OR ANY OTHER PARTY FOR ANY LOSS, DAMAGE, OR INJURY THAT RESULTS FROM THE USE OR APPLICATION BY CUSTOMER, CUSTOMER’S CUSTOMER, OR ANY OTHER PARTY, OF PRODUCTS DELIVERED TO CUSTOMER, UNLESS THE LOSS OR DAMAGE RESULTS DIRECTLY FROM THE INTENTIONALLY TORTIOUS OR FRAUDULENT ACTS OR OMISSIONS OF US. IN NO EVENT SHALL WE BE LIABLE TO CUSTOMER OR ANY OTHER PARTY FOR LOSS, DAMAGE, OR INJURY OF ANY KIND OR NATURE ARISING OUT OF OR IN CONNECTION WITH THESE TERMS AND CONDITIONS, OR ANY AGREEMENT INTO WHICH THEY ARE INCORPORATED, OR ANY PERFORMANCE OR NONPERFORMANCE UNDER THESE TERMS AND CONDITIONS BY IT NETWORKS AUSTRALIA, ITS EMPLOYEES, AGENTS OR SUBCONTRACTORS, IN EXCESS OF THE NET PURCHASE PRICE OF THE PRODUCTS OR SERVICES ACTUALLY DELIVERED TO AND PAID FOR BY CUSTOMER HEREUNDER. IN NO EVENT SHALL SYNNEX BE LIABLE TO CUSTOMER OR ANY OTHER PARTY FOR INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO LOSS OF GOOD WILL, LOSS OF ANTICIPATED PROFITS, OR OTHER ECONOMIC LOSS ARISING OUT OF OR IN CONNECTION WITH OUR BREACH OF, OR FAILURE TO PERFORM IN ACCORDANCE WITH ANY OF THESE TERMS AND CONDITIONS, OR THE FURNISHING, INSTALLATION, SERVICING, USE OF PERFORMANCE OF ANY PRODUCTS OR INFORMATION WE SHALL PROVIDE HEREUNDER, EVEN IF NOTIFICATION HAS BEEN GIVEN AS TO THE POSSIBILITY OF SUCH DAMAGES.
We reserve the rights to change/alter Terms and Conditions of our website without prior notice to you and you agree to be bound by such modifications, alterations or updates. You agree that it is your responsibility to check the websites for any changes to these Terms and Conditions.
We may modify the information and functionality of our website/s at any time.
We reserve the right to reject your order for products purchased through our website for any reason, including but not limited to, if the products are not available, if there is an error in the description or price of the requested products as advertised or if there is an error in your order. If we reject your order, we will endeavour to notify you by email of our rejection at the time you place the order or within a reasonable time thereafter and give you the option of reconfirming you order, changing your order or cancelling your order. If we are unable to contact you, we will treat the order as cancelled. If your order is cancelled and you have already paid for the products, you will receive a full refund.
